What should i do on a traffic stop when i get pulled over, what are my rights?

There are many false assumptions people make during a traffic stop.  This is a suggestion to minimize the impact of a traffic stop if the police pull you over.  First even if you are angry or annoyed, if you think they have no reason to stop you, the reality is that the police have procedures to follow.  You don’t have to agree with these laws or procedures but the judge will enforce them in court.  The traffic stop is not where you argue probable cause or innocence or guilt, that is for court and a judge.  The law enforcement officer (LEO) is in charge by rule of law.  If you are polite, you are more likely to receive a warning or less severe violations.  You have the right to ask why you are pulled over, but the officer decides when they tell you.  You must, by law provide identification, your drivers’ license is the property of the state and must be surrendered upon request, not just shown but given to LEO.  Driving is a privilege granted by the state not a right.  To operate a motor vehicle, meaning sitting in vehicle at the control of steering wheel, accelerator and brake, is driving, travelling or any term you wish to use, you must have a valid license, current registration and insurance.  The rarely used “sovereign citizen” defense or “i’m not driving i’m travelling” excuse is not real, it is an internet fable that will never work.  By US Supreme Court ruling Pennsylvania v. Mimms 434 US 106 of 1977, the police can ask you to exit the vehicle regardless of why you are stopped.  Once a traffic stop is initiated it is an active investigation, only the LEO decides when it is complete, meaning you must comply to any lawful order or you can be arrested.  The best course of action is to be friendly polite and follow all instructions, this will minimize your penalties maybe even let go with simple warning.  Arguing or demanding answers while not answering questions or complying with commands is a sure way to receive maximum violations, being removed from vehicle even arrested.  Most police departments in the US have license plate reader systems. meaning a police car can read the sticker on your license plate wirelessly through RF signals.  They know the registered owner of the vehicle, whether they have any active warrants, a valid drivers license, current registration and in some states even whether you have active insurance.  They have this info before you are even pulled over.  Now people who usually give the police the most trouble are drivers with warrants, suspended or revoked license, no insurance or other issues they are trying to distract from.  People will flee, delay pulling over until they reach a parking spot where they feel they won’t get towed, argue the reason for the stop, fail to identify, fail to comply with lawful orders.  Fleeing is the worst thing you can do, less than 1% get away and most of them are caught soon after and are guaranteed jail time and no mercy from the judge.  Even if you know the outcome will be bad, it is even more reason to be polite and compliant, this gives you the best chance of the officer to write minimal violations and in court the judge will be far more lenient with their decisions.  If all you need to drive legally is auto insurance, call Wessell Insurance Services “The SR22 Specialists” 866 663 7561 we have been helping high risk drivers get insured and reinstate their license for 20 years.
